These Terms and Conditions ("Terms") govern your use of https://michiganrestaurantjobs.com and the services offered on it (the "Service"), operated by Michigan Restaurant Jobs ("we", "us", or "our"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You may use the Service only if you can form a binding contract with us and are permitted to work under applicable law. If you are under 18 you should use the Service only with the involvement of a parent or guardian.
2. What we do
We are a job discovery service focused on restaurant jobs in Michigan. We gather job listings from employers and their applicant tracking systems and present them on a map so you can find openings near you and apply directly with the employer. We are not an employer, a staffing agency, or a recruiter, and we are not a party to any application, interview, hiring decision, or employment relationship.
3. Job listings and accuracy
Listings come from live employer feeds and can change, be filled, or expire at any time. We work to keep them current but we do not guarantee that any listing is accurate, complete, still open, or free of errors, and a listing is not an endorsement of the employer. Always confirm the details, pay, and requirements directly with the employer before relying on them.
4. Applying with employers
When you apply, you leave our Service and go to the employer's own hiring site. That site and the employer's hiring process, decisions, and handling of your information are governed by the employer, not by us. We do not guarantee that you will receive a response, an interview, or a job, and we are not responsible for the conduct of any employer.
5. No employment relationship
Nothing on the Service creates an employment, agency, partnership, or joint venture relationship between you and us. We do not screen employers or jobseekers and make no representations about either.
6. Employer and advertiser submissions
If you submit information through our "Get a quote" form or otherwise ask us to list your jobs, you represent that the information is accurate and that you have the right to provide it and to have the jobs listed. You are responsible for the content of your listings, which must be lawful, non-discriminatory, and for genuine openings. We may decline, edit, or remove any listing at our discretion.
7. Acceptable use
You agree not to:
- scrape, copy, harvest, or collect listings or data by automated means;
- resell, republish, or redistribute content from the Service without our permission;
- use the Service for any unlawful, fraudulent, or discriminatory purpose;
- post or transmit malware, or interfere with or disrupt the Service;
- impersonate any person or misrepresent your affiliation with anyone;
- attempt to gain unauthorized access to any part of the Service.
8. Intellectual property
The Service, including its design, text, graphics, and the arrangement of listings, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for your own job search or hiring needs. Job listing content belongs to the respective employers.
9. Third-party links and content
The Service contains links to third-party sites and content that we do not control. We are not responsible for those sites or their content, products, or practices, and linking does not imply endorsement.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or secure, or that any listing is accurate or available.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of jobs, wages, data, or opportunities, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed one hundred US dollars.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, and expenses, including reasonable legal fees, arising from your use of the Service, your content, or your violation of these Terms.
13. Changes to the Service and Terms
We may change or discontinue the Service at any time. We may also update these Terms, and when we do we will update the effective date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Termination
We may suspend or end your access to the Service at any time if you violate these Terms or misuse the Service.
15. Governing law and disputes
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction. Before filing any claim, you agree to contact us so we can try to resolve it informally.
16. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them freely. These Terms are the entire agreement between you and us regarding the Service.
